Terms of Service

These Terms of Service ("Terms") govern your use of software products and services provided by beGump LLC ("GUMP", "we", "us", "our"), a New Jersey limited liability company. By purchasing, downloading, installing, or using any GUMP product, you agree to these Terms.

1. PRODUCTS AND LICENSING

GUMP products are licensed, not sold. A subscription grants you a non-exclusive, non-transferable, revocable license to use the software for the duration of your paid subscription. One license per machine unless otherwise agreed in writing. You may not sublicense, resell, redistribute, reverse engineer, decompile, or create derivative works from any GUMP product.

2. SUBSCRIPTIONS AND PAYMENT

Subscriptions are billed monthly through Stripe. You authorize recurring charges to your payment method. You may cancel at any time through your Stripe customer portal. Cancellation takes effect at the end of the current billing period. No partial refunds for unused portions of a billing period. We reserve the right to change pricing with 30 days written notice.

3. REFUND POLICY

If you are unsatisfied with any GUMP product within the first 30 days of your initial subscription, contact [email protected] for a full refund. After 30 days, all charges are final. Refunds are issued to the original payment method and may take 5-10 business days to process.

4. SOFTWARE PROVIDED "AS IS"

GUMP PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

We do not warrant that the software will be error-free, uninterrupted, or meet your specific requirements. Computational results are produced by algorithms and should be independently verified before making decisions with significant consequences.

5. SPECIFIC PRODUCT DISCLAIMERS

Fold Watch: This product provides computational analysis of protein sequences including 3D structure prediction, misfolding risk assessment, disorder detection, aggregation screening, and food protein analysis. It is NOT a medical device, NOT a diagnostic tool, NOT a food safety certification, and NOT a substitute for professional scientific judgment. 3D structure predictions are residue-level estimates, not atom-level coordinates. Disorder scores are computational indicators, not clinical diagnoses. Misfolding risk scores and food allergen assessments are computational estimates based on sequence properties, not experimental measurements. Do not make drug development, clinical, treatment, food safety, or regulatory decisions based solely on Fold Watch output. Always consult qualified professionals and perform independent experimental validation.

Chip Fast: Chip placement results are computational estimates for early-stage exploration. Final chip designs require professional EDA tools, process design kits (PDKs), and verification by qualified engineers. Do not fabricate silicon based solely on Chip Fast output without independent verification.

AI Trainer: Training recommendations (including stop signals) are algorithmic estimates based on observed metrics. Model behavior may vary. We are not liable for decisions made based on grokking detection output, including premature training termination or continued training past recommended stop points.

Universal Sensor: Regime detection and anomaly identification are computational assessments. Do not make medical diagnoses, financial trades, or safety-critical decisions based solely on Universal Sensor output without independent professional verification.

Org X-Ray: Network analysis provides structural insights based on the data you provide. Results reflect the input data, not necessarily the full reality of organizational dynamics. Do not make employment decisions based solely on algorithmic output.

Trace: Spectral forensics identifies structural patterns in transaction data. Results are computational analysis, not legal conclusions. Trace does not constitute evidence of fraud, money laundering, or any criminal activity. Always engage qualified forensic accountants and legal counsel before acting on Trace output. Backtests use synthetic data mirroring documented fraud structures.

Dissonance: Spectral security monitoring detects behavioral anomalies, not specific threats. An alert does not confirm an attack, and absence of alerts does not confirm security. Dissonance is not a replacement for endpoint protection, antivirus, firewalls, or professional security services. Always maintain defense-in-depth.

Oracle: Spectral prediction finds periodic patterns in historical data and projects them forward. Forecasts assume past patterns continue. Oracle cannot predict regime changes, black swan events, or non-periodic phenomena. Do not make financial trades, medical decisions, or safety-critical choices based solely on Oracle output. Confidence scores indicate pattern strength, not prediction accuracy.

Accord: Compliance intelligence identifies potential regulatory gaps and suggests strategies. Accord is NOT legal advice, NOT a law firm, and NOT a substitute for qualified legal counsel. Do not rely solely on Accord output for compliance decisions. Counter-strategies are informational — a licensed attorney must evaluate applicability. Accord does not file documents, represent you before regulators, or create attorney-client privilege.

Turbo: The K→Native compiler produces optimized binaries from K source code. Benchmark figures reflect specific test conditions on specific hardware. Performance varies by workload, hardware, and code complexity. Compiled binaries are provided "as is." Verify correctness of compiled output independently before use in production or safety-critical applications.

6. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEGUMP LLC AND ITS MEMBERS, OFFICERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE PRODUCTS; (B) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; (C) ANY THIRD-PARTY CONDUCT ON THE SERVICE; OR (D) ANY OTHER MATTER RELATING TO THE PRODUCTS.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO BEGUMP LLC DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

7. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless beGump LLC, its members, officers, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the products, your violation of these Terms, or your violation of any rights of another party.

8. DATA AND PRIVACY

GUMP products run locally on your hardware. We do not collect, store, transmit, or have access to your data. Your data never leaves your machine. See our Privacy Policy for details. The licensing system may transmit a machine fingerprint and license key to our servers for validation purposes only.

9. INTELLECTUAL PROPERTY

All GUMP software, algorithms, K language specifications, compiled binaries, documentation, and branding are the exclusive intellectual property of beGump LLC. Patent pending. All rights reserved. "GUMP", "Harmonia", "Org X-Ray", "Learn Engine", "Fold Watch", "Chip Fast", "AI Trainer", "Knowledge Engine", "Universal Sensor", "Trace", "Dissonance", "Oracle", "Accord", and "Turbo" are trademarks of beGump LLC.

10. TERMINATION

We may terminate or suspend your license immediately, without prior notice, if you breach these Terms, including but not limited to: reverse engineering, unauthorized redistribution, tampering with the licensing system, or using the software for illegal purposes. Upon termination, your license to use the software ceases immediately.

11. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in New Jersey.

12. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or on our website. Continued use of the products after changes constitutes acceptance of the modified Terms.

14. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and beGump LLC regarding the use of our products and supersede all prior agreements and understandings.

By purchasing or using any GUMP product, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
